General Terms of Business

(The terms outlined below include statutory information relating to your legal rights per the contract regulations for distance selling, and sales by electronic means.)

Scope

The following terms apply to all goods sold by Sokalo.

Parties to the contract

The terms and conditions set forth in these terms of purchase (this ("Agreement") and the "Terms of Access" constitute an agreement between Sokalo (“Sokalo”,”we”,”our”,”us”) and you, the visitor (the "Buyer") concerning your access and use of all content and functionalities available at the Sokalo Website.

Offer and Acceptance

By ordering a product on the Website, you shall be deemed to have made an offer to buy the specified product from Sokalo pursuant to this Agreement. The acceptance and fulfillment by Sokalo of any order placed on the Website is subject to Buyer's acceptance of all of the terms of this Agreement.

Prices, Availability and Taxes

Prices of products shown on the Website are in US Dollars and are subject to change at any time without notice. All products may not be available in all areas. Product availability is subject to change at any time and Sokalo makes no representations of warranties regarding product availability. You shall be responsible for any tax or other governmental charge due to the sale, use or delivery of the product, including, but not limited to, Value Added Tax, Sales Tax, Use Tax, Retailer's Occupational Tax, Gross Revenue Tax, Value Accrued or, and Transportation Tax. All applicable taxes and other charges will be added to the purchase price.

Shipping, Title and Risk of Loss

Sokalo will ship products using the shipping method selected by you on our Website. Sokalo shall use reasonable efforts to cause products to be delivered to you by requested delivery dates, but shall in no event be liable for any losses or damages caused by delay or non-delivery of products. You are responsible for all shipping charges. We require a signature for any goods delivered to you, at which point the responsibility for your purchased goods passes to you. If the recipient is a third party e.g. as a gift, then you accept that a signature by them (or at the delivery address) is evidence of delivery and fulfillment by Sokalo, at which point the responsibility of the purchased goods transfers in the same way.

Payment

When ordering products on the Website, payment can be through Paypal. If you wish to pay through another form of payment please contact the Sokalo team. If you fail to pay for any products received, Sokalo reserves the right, in addition to other remedies, to suspend or cancel further deliveries, and to proceed in any court of proper jurisdiction against you for all amounts due to Sokalo, including, but not limited to, legal fees, costs and interest. You acknowledge and agree that we will take all reasonable care to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss or damage you may suffer if a third party procures unauthorized access to any data or information that you provided when accessing or ordering from the website.

Reservation of Title

Until paid for in full, all goods sold on this website shall remain our property.

Transport Damage

Defective goods should be immediately reported to the shipper and to Sokalo. Failure to contact us shall not influence your statutory warranty rights. But your cooperation will help us make our own claims against the shipper or transport insurance company.

Returns, Changes and Cancellation We want you to love the products you buy at Sokalo as much as we do, but if you don't then you can send them back to us within 30 days after the receipt of the products. We will be happy to offer you a full refund or exchange it for another product. We don't refund the original post and packaging charge.

If you do need to return something then this is at your own cost and we strongly recommend you keep a proof of postage and send it by registered mail. If you have a proof of postage you don't need to inform us.

To return your purchase by mail please put the goods in a box with a copy of the receipt, your name, address and merchandise. You will be responsible for the shipping and handling charges and notify us through customercare@sokalo.com. You will need to send the goods directly to the individual designers from whom the goods are. Their address can be found online under their profiles. If you have questions regarding please contact our customercare team.

Please not that Sokalo can only take goods back that are undamaged and unused. If the merchandise is defective, please notify Sokalo immediately upon receipt of the goods.

Refunds or Store Credit

Authorized returns will be refunded a full amount of merchandise to your original account as soon as we get the returns from you. If you prefer to have a store credit, it will be applied to your next order.

Limitation of Claims

All claims related to products sold through the Sokalo website must be made within 30 days after the receipt of the products. If the buyer wishes to claim of non-delivery, it must be made within 30 days after the scheduled delivery date. If the buyer fails to provide written notice to Sokalo of any claim within this time period, then Sokalo Ltd shall constitute an unconditional waiver of the claim.

Disclaimer of Warranties

Sokalo disclaims all warranties concerning its products, which also includes non-infringement, merchantability or fitness of the products for any purpose. The buyer is solely responsible for determining the fitness of all products for any particular purpose; the buyer also assumes all risks and liabilities of possession, use, or resale of all products. Sokalo does not guarantee the uninterrupted functionality of the website, nor that the information presented on the website is necessarily up-to-date.

Buyer's Representations

The Buyer acknowledges that he/she is familiar with the characteristics of the products he/she ordered, and will comply with all laws, regulations, and standards applicable to the possession, handling, processing, and/or use of the products by the Buyer. This also includes the Occupational Safety and Health Act.

General

Nothing expressed herein shall limit Sokalo in its capacity to remedy the consequences of a Buyer's breach of this Agreement. All notices related to this Agreement must be in writing. No term or condition expressed in the Terms of Purchase shall affect the validity or enforceability of any other term or condition expressed herein. The terms and conditions expressed herein shall comply with and be construed under the laws of Austria, without any regard to the conflict of laws principles. Any legal action related to any transaction subject to this Agreement shall be commenced within one year after the cause of action and shall be commenced in the courts of Austria. The Buyer agrees to submit to the jurisdiction of these courts and waives any right to claim that such venue is improper for any reason.
